Please read these terms carefully before using NovaQore's custom development services.
1. Acceptance of Terms
By accessing or using NovaQore's custom development services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use our services.
2. Development Services
NovaQore provides custom development services including websites, mobile applications, and APIs. All services are provided on a project basis with specific deliverables, timelines, and requirements outlined in individual project agreements.
3. Project Agreements
Each development project will be governed by a separate project agreement that outlines scope, timeline, deliverables, and payment terms. These Terms of Service apply to all projects unless specifically modified in writing.
4. Payment Terms
Payment terms will be specified in individual project agreements. Generally, projects require a deposit before work begins with remaining payments tied to milestone completions or project delivery.
5. Intellectual Property
Upon full payment, clients retain ownership of custom-developed applications. NovaQore retains rights to general methodologies, frameworks, and any pre-existing intellectual property used in development.
6. Free Hosting Terms
NovaQore provides free lifetime hosting by leveraging free tier services from platforms like Vercel, Google Cloud, Firebase, and similar providers. We extend these free services to our clients at no additional cost. However, this arrangement is subject to the following conditions: (a) If any hosting provider discontinues their free tier or promotional offerings, NovaQore reserves the right to adjust or discontinue free hosting services with 30 days notice; (b) Usage limits are identical to those imposed by the hosting providers (typically bandwidth, storage, and compute limits); (c) If your project exceeds these free tier limits, you will be responsible for additional hosting costs based on the provider's overage pricing; (d) NovaQore will notify you before any charges are incurred and provide options for optimization or paid hosting arrangements.
7. Free Maintenance Terms
NovaQore provides free lifetime maintenance to ensure your application remains functional and secure. This maintenance service includes: (a) Security updates and patches for the core application; (b) Framework and dependency updates to maintain compatibility; (c) Bug fixes for issues that arise from our original development; (d) Performance monitoring and optimization; (e) Basic uptime monitoring and issue resolution. This maintenance does NOT include: (a) New feature development or functionality changes; (b) Design updates or content modifications; (c) Third-party plugin, API, or service integration issues; (d) Issues caused by external dependencies or services beyond our control; (e) Custom modifications or enhancements requested after project completion. We are not responsible for the functionality, security, or availability of third-party services, APIs, or plugins integrated into your project.
8. Warranties and Liability
NovaQore provides development services 'as-is' and makes no warranties regarding uptime, performance, or fitness for specific purposes. Our liability is limited to the total amount paid for services.
9. Modifications and Termination
Either party may terminate a project agreement with written notice. NovaQore reserves the right to modify these terms with 30 days notice. Continued use of services constitutes acceptance of modified terms.
